Article 76. Exercise of parental rights by the parent living separately from the child
Family code of the Republic of Uzbekistan · Date: 30.04.1998 · In force
The parent living separately from the child shall have the right to communicate with the child, participate in his/her upbringing, and address the issues of the child's education.
The parent with whom a child is living shall not impede communication between the child and the other parent, provided that such communication does not harm the child's physical or mental health or moral development.
The parents are entitled to conclude a written agreement on the procedure for exercising the parental rights of the father (mother) who lives separately from the child. A dispute in this regard may be resolved through mediation proceedings before applying to the court based on the demand of the parents (or one of them).
If the parents cannot reach an agreement, the dispute shall be resolved by the court at the request of the parents (or one of them) with the participation of the guardianship and curatorship body. In the event of non-compliance with the court decision, measures provided for by legislation shall be applied to the guilty parent. In the event of deliberate non-compliance with the court decision, the court may render a decision on awarding the child to the father (mother) who lives separately from the child, based on their request and taking into account the interests and opinion of the child.
A parent living separately from his/her child shall have the right to obtain information about his/her child from educational, treatment, social-welfare, and other similar institutions. Provision of the information may be refused only if there is a threat to the life and health of the child on the part of the parent. Refusal to provide information may be appealed in court.
