Article 61. Establishment of the origin of a child upon the parents' appeal
Family code of the Republic of Uzbekistan · Date: 30.04.1998 · In force
Paternity of a person who is not married to the child's mother shall be established upon a joint statement of the mother and the person admitting to be the child's father, submitted to the civil registry office.
If the mother is deceased, declared legally incapable by a court, or if the mother cannot be located, or if she is deprived of parental rights, paternity shall be established on the basis of a statement of the person who acknowledges himself the child's father, agreed upon with the guardianship and trusteeship body.
If the child's father is declared legally incapable by a court, a statement for the acknowledgement of paternity may be filed on his behalf by his guardian, with the consent of the guardianship and trusteeship body.
A statement for the acknowledgement of paternity may be filed upon registration of the birth of a child, as well as once the birth of a child is registered. In the presence of circumstances that give reason to believe that it may be impossible or difficult to submit a joint statement for the establishment of paternity after the birth of the child, the parents of the future child who are not married to each other, shall be entitled to submit such a statement to the civil registry office during the pregnancy of the mother.
Refusal to establish paternity may be appealed in court by the person who acknowledges himself as the father of the child.
