Article 52. Annulment of marriage concluded in the presence of obstacles to conclusion of the marriage

A marriage concluded in the presence of circumstances listed in Article 16 of the present Code shall be declared invalid.

If the circumstances preventing from the conclusion of the marriage cease by the time the case is resolved, the court shall be entitled to recognize the marriage as valid on the time when the circumstances cease to exist.

Spouses, persons whose rights are violated by the conclusion of the marriage, as well as the guardianship and trusteeship body and the prosecutor shall be entitled to request the annulment of a marriage on the grounds listed in Article 16 of the present Code.

A case on the annulment of a marriage concluded with a person who has been declared by a court legally incapable shall be considered with the participation of the guardianship and trusteeship body.
