Article 110. Amount and procedure for provision of maintenance for parents

Where capable adult children refuse to voluntarily provide financial support to their parents, the amount of maintenance shall be determined by court decision, taking into account the family and financial situation of the children.

Regardless of the parents' claim for maintenance for one or more children, the court shall consider all capable adult children when determining the amount of alimony.

The judge in a dispute over the recovery of alimony from capable adult children may make prior to its final resolution a determination specifying the temporary recovery of the necessary amount.

The amount of alimony recovered from capable adult children shall not be less than 11.75 percent of the statutory minimum wage.
