Citizens, as well as heads and other officials of enterprises, institutions, and organizations, must, upon the lawful request of the court, submit the electronic data at their disposal, necessary for use in the performance of judicial actions, together with the electronic media.
If the person from whom the digital evidence is requested by the court is unable to submit it within the time limit established by the court, this person must notify the court thereof, indicating the reasons.
A person voluntarily submitting digital evidence shall report what circumstances of relevance to the case can be established by means of this evidence.
A person participating in the case is entitled to file a motion with the court to request digital evidence of relevance to the case that is at the disposal of other persons. In this case, the person filing the motion shall declare on what grounds the digital evidence is held by a specific person, as well as its location.
The court may issue an inquiry to the person filing a motion for requesting digital evidence, granting the right to obtain the digital evidence for submission to the court.
Citizens, as well as heads and other officials of enterprises, institutions, and organizations not participating in the case and unable to submit the digital evidence requested by the court, must notify the court thereof, indicating the reasons.
Digital evidence requested by the court from state bodies, organizations, or citizens shall be sent directly to the court.
In the event that the court is not notified, as well as if the submission of digital evidence is refused without valid reasons, the court shall impose a fine on the guilty officials of organizations, as well as on citizens, in the manner established by Article 146 of this Code.
The imposition of a fine shall not release officials and citizens from the obligation to submit the digital evidence requested by the court.
