Article 51. Procedural rights and responsibilities of the prosecutor
Civil procedure code of the Republic of Uzbekistan · Date: 22.01.2018 · In force
The applicant prosecutor enjoys all the procedural rights of the plaintiff and assumes all procedural obligations, except for the right to enter into a settlement agreement or mediation agreement and the obligation to pay court costs.
The prosecutor shall have the right to waive the asserted claim whether in whole or in part; provide the court with explanations on the claims he/she has made to protect the rights and interests of other persons; express his/her opinion on the merits of the case, as well as on certain issues arising during the proceedings; and to protest the judicial act.
The prosecutor shall not be entitled to change the ground or subject matter of the claims asserted by him/her; assert additional claims; increase or decrease the amount of claims; unless consent is given by the plaintiff.
The refusal of the claimant of the claim, which was brought in defense of his rights by the prosecutor, entails leaving the statement of claim (application) without consideration, if the rights, freedoms and legitimate interests of third parties are not affected.
Prosecutor's waiver to file a suit (claim) asserted to protect another person's interests shall not deprive that person of the right to demand considering of the case on its merits.
