Article 42. Capacity to be sued under civil procedure
Civil procedure code of the Republic of Uzbekistan · Date: 22.01.2018 · In force
The ability to exercise their rights and duties in court shall belong to citizens who have reached the age of majority, as well as to organizations.
Protection of the rights and legally protected interests of minors, i.e. citizens between the ages of 14 and 18, as well as citizens recognized as having limited legal capacity shall be pursued in court by their parents, adoptive parents, or guardians. This shall not, however, deprive minors and citizens recognized as having limited legal capacity of the right to participate in such cases.
Minors have the right to personally defend their rights and legally protected interests in court in cases of recovery of alimony from parents, as well as in cases arising from employment-related legal relationships and agreements related to the management of wages or other income. The issue of involving their parents, adoptive parents or guardians to assist minors in such cases shall be decided by the court.
A minor who has reached the age of sixteen may exercise his rights and obligations in person in court in the event that he is declared legally competent (emancipation) in accordance with the procedure established by law.
The rights and legally protected interests of minors under the age of fourteen, as well as those of citizens who have been declared legally incapable due to their mental disorder shall be protected in court by their legitimate representatives, such as parents, adoptive parents, or guardians.
