Article 4072. Procedure and Time Limit for Resolving the Issue of Accepting a Cassation Complaint (Protest) for Proceedings

The issue of returning, refusing to accept, or accepting a cassation complaint (protest) for proceedings shall be resolved individually by a judge of the cassation instance court no later than five days from the date the complaint (protest) is received by the court.

A ruling shall be issued on the return, refusal to accept, or acceptance of the cassation complaint (protest) for proceedings. A copy of the ruling shall be sent to the persons participating in the case no later than the day following its issuance, in the manner prescribed by Article 270 of this Code.
