Article 358. Court ruling on the case on issuing the writ of execution for enforcement of the decision of arbitration court

Based on the results of the consideration of the case on issuing the writ of execution for enforcement of the decision of arbitration court, the civil court shall render a ruling according to the rules stipulated by this Code for rendering a decision.

The ruling of the civil court on issuing the writ of execution for enforcement of the decision of arbitration court or on denial of the issuance of the writ of execution for enforcement of the arbitration court decision shall also contain the following:

1) Title and composition of the arbitration court, which rendered the decision;

2) Surname, name, patronymic (title) of the parties to the arbitration proceedings;

3) Information on the decision of arbitration court;

4) Reference to issuance of a writ of execution for enforcement of the arbitration court decision or denial of the issuance of a writ of execution.

Denial of the issuance of the writ of execution for enforcement of the arbitration court decision shall not prevent the parties to the arbitration proceedings from applying in accordance with the arbitration agreement to the arbitration court again, if the possibility of applying to the arbitration court is not lost, or from applying to the civil court according to the rules, stipulated by this Code.

If the issuance of the writ of execution for enforcement of the decision of arbitration court is denied by the civil court either in whole or in part due to the invalidity of the arbitration agreement, or as a result of the fact that the decision was rendered on a dispute not provided for by the arbitration agreement or not falling under its terms and conditions, or contains judgments on matters not covered by the arbitration agreement, or the dispute cannot be the subject of arbitration proceedings, the parties to the arbitration proceedings may apply for the resolution of such dispute in civil court under the rules, stipulated by this Code.

Ruling of the civil court on the case on issuing the writ of execution for enforcement of the decision of arbitration court shall be subject to immediate execution.
