Article 317. Filing the application

The application on involuntary hospitalization of a person or extension of the hospitalization period shall be filed with the court by the psychiatric institution where the person is being held.

The application, which shall specify the legal grounds for involuntary hospitalization of a person in a psychiatric hospital shall be accompanied by a reasoned conclusion of the commission of psychiatrists on the necessity of further stay of the person in a psychiatric hospital.

The application shall be considered in court at the location of the psychiatric institution.

Accepting the application, the court shall simultaneously decide on the issue of stay of the person in a psychiatric hospital for the period necessary for consideration of the application in court.
