Article 281. The rights of the appeared party

If a plaintiff, who appeared at the court session, does not agree to the consideration of the case under absentia proceedings in the absence of the defendant, the court shall postpone the court trial and send to the defendant, who failed to appear, a second notice of the time and place of a new court trial.

In case of repeated failure of the duly notified defendant to appear, the court shall consider the case under absentia proceedings regardless of the plaintiff's opinion.
