Article 2792. Cases considered in the simplified proceedings

Cases on statements of claim shall be considered under the simplified proceedings procedure if the value of the claim does not exceed one hundred and fifty times the base calculating quantity for legal entities, one hundred times for individual entrepreneurs, and fifty times for individuals.

At the request of the claimant, with the consent of the defendant, other cases may also be considered through simplified proceedings, unless the circumstances specified in parts three and five of this article exist.

The court issues a ruling to consider the case according to the general rules of claim proceedings if, during the consideration of the case in a simplified procedure, the following circumstances are established:

1) consideration of the case in the simplified procedure may lead to the disclosure of a state secret, commercial or other legally protected secret;

2) it is necessary to find out additional circumstances or investigate additional evidence, as well as to inspect and examine evidence at their location, appoint an expert examination or hear testimony;

3) the stated claim is related to other claims, including those relating to third parties, or a judicial act adopted in this case may violate the rights and legally protected interests of third parties;

4) during the consideration of the case in the simplified procedure, a counterclaim was filed that is not subject to consideration according to the rules established by this chapter.

The ruling on the transition to consideration of the case according to the general rules of claim proceedings shall indicate the grounds for the transition to the general procedure. After the ruling is made, the case is considered again.

If several interconnected claims are filed, one of which relates to the claims specified in part one of this article, and the others do not relate to them, all claims are subject to consideration according to the general rules of claim proceedings established by this Code.

The term of consideration of the case is calculated from the date of the ruling on the consideration of the case according to the general rules of the claim proceedings.
